Terms of service

These terms are an agreement between you and Neetix, the operator of the Neetix Liveliness API. Creating an API key, calling the API, or purchasing credits means you accept them. If you are signing up on behalf of a company, you confirm you have the authority to bind it.

The free trial exists so you can evaluate the API with real requests, not so you can run production traffic on it indefinitely.

• One trial key per email address. Registering multiple addresses to farm trial credits is a breach.
• Trial and paid traffic are subject to per-key and per-IP rate limits. Limits are stated in the docs and may be tightened without notice to protect the service.
• Keys used to circumvent limits or abuse the trial may be revoked without notice.

• Credits are prepaid and deducted per verification as described on the pricing page. They are non-transferable between accounts and have no cash value outside the service.
• Payments are processed by Dodo Payments as merchant of record. Refunds are handled under their refund policy; where a refund is approved, unused credits from that purchase are removed from your balance.
• If a payment is charged back or reversed, the credits from that payment are clawed back immediately. If your balance goes negative as a result, the key may be suspended until it is settled.

You may not use the API to:

• Conduct unlawful surveillance, or identify or track individuals without a lawful basis to do so.
• Submit a person's facial images without their valid consent. You are the data fiduciary for your end users under the DPDP Act, 2023 and must obtain and record consent before sending us their images.
• Scrape the service, resell raw API access without an agreement, run automated benchmark harvesting, or probe the models to build a competing dataset.
• Break the law of any jurisdiction that applies to your use of the results.

Breach of this section is grounds for immediate suspension of your keys.

The service is in beta. It is provided as-is, without an uptime commitment; there is no SLA unless you have a signed enterprise agreement that says otherwise. We may run maintenance, change endpoints with notice in the docs, and throttle traffic to keep the platform healthy. Verification scores are inputs to your decisions — the decision itself, and responsibility for it, stays with you.

To the maximum extent permitted by law, Neetix's total aggregate liability under these terms is capped at the fees you paid us in the three months before the event giving rise to the claim. We are not liable for indirect or consequential losses, lost profits, or losses arising from decisions made on the basis of verification results.

You can stop using the service and close your account at any time. We may suspend or terminate keys that breach these terms, create security risk, or carry unpaid balances. On termination your remaining credits are handled per the refund terms above; audit and billing records are retained as described in the privacy policy.

These terms are governed by the laws of India, and disputes are subject to the jurisdiction of the courts of India. We may update these terms; updates are published here with a new effective date, and material changes are emailed to account holders. Continued use after the effective date means the updated terms apply.
